Legal matters that people often misunderstand!

In daily life, many individuals operate based on fundamental misunderstandings of key legal principles. These misconceptions can inadvertently lead to complex and costly legal issues. Knowing the correct legal facts is far more crucial than relying on common assumptions.

Alpha Lawyers, a Korat lawyer specializing in general civil law and labor law, would like to point out three legal issues related to everyday life that most people often misunderstand.

1. Labor Law: A Verbal Resignation Is NOT the Final Word The Misconception: An employee’s verbal notification to their manager or simply abandoning the job immediately terminates the employment relationship. The Legal Fact: Under labor law, a proper and effective resignation requires a clear process, most importantly, a written notice submitted in advance, usually equivalent to at least one pay cycle or the period stipulated in the employment contract. 2. Contract Law: Verbal Agreements Are Legally Binding (But Extremely Hard to Prove) The Misconception: Contracts must be in writing, signed, and sometimes notarized to be legally valid. Verbal agreements hold no legal standing. The Legal Fact: Under the Civil and Commercial Code, a contract is formed immediately upon mutual consent (Offer + Acceptance), whether this occurs through conversation, over the phone, or via chat. This is legally binding, unless the law specifically dictates that the contract must be in writing (e.g., the transfer of real estate). 3. Property Law: Peaceful Possession Does Not Grant Automatic Ownership! The Misconception: If you have quietly occupied someone else’s land or house for many years without the rightful owner ever challenging you, you automatically become the owner through adverse possession. The Legal Fact: To acquire ownership of another person’s real estate through Adverse Possession (Prescriptive Title), you must possess the land peacefully, openly, with the intent of ownership, for a continuous period of 10 years. More importantly, this process is not automatic. You must then file a petition with the court and successfully register the new title with the land department officials.   A safe and secure life depends on comprehensive legal understanding. Alpha Lawyers is ready to handle every detail to help you navigate legal complexities confidently.
