Filing for divorce is already a complex matter — but it becomes more complicated when your spouse is a foreign national. Thai courts require compliance with both Thai law and the foreign spouse’s national law.
Important considerations before filing for divorce from a foreign spouse in Thailand:
1. The marriage must be legally registered either in Thailand or abroad.
2. The party filing the divorce must prove that under the laws of the other spouse’s nationality, divorce is legally permitted.
– For example, if you are divorcing a British spouse, you must submit a translated copy of the relevant British law showing that divorce is allowed.
– The foreign law must be translated into Thai and submitted to the Thai court.
3. The grounds for divorce must follow Section 1516 of the Thai Civil and Commercial Code.
4. If the foreign law is not submitted, the Thai court will reject the case.
